Terms of purchase
The following terms and conditions of purchase apply to the use of the website www.forlossningspool.se.
Forlossningspool.se is operated by Ganymedes Konsult Aktiebolag with registration number 556991-9748 and is the supplier of all goods ordered through the website.
Definitions
1.1 “Agreement” means these Terms and Conditions of Purchase.
1.2 “Order” means any order placed by the Customer on the Website.
1.3 “Customer” means the natural person who orders products on the Website.
1.4 “Product(s)” means the products offered for sale and rent on the Website and supplied by forlossningspool.se.
1.5 “The Website” means the website of forbirningspool.se www.forlossningspool.se.
Confirmation
2.1 In order to enable the purchase or rental of products on the Website, the Customer must accept all the terms and conditions of this Agreement and provide the information required at the checkout to complete a purchase.
2.2 The Customer accepts the terms and conditions of purchase by providing information at the checkout when a purchase is made.
2.3 An individual may not purchase products on the Site, nor accept the terms and conditions of purchase, if (a) the individual is not 18 years of age and therefore cannot enter into a binding contract with forlossningspool.se, or (b) the individual is prevented from receiving products or using the website under the laws of the country in which the Customer resides or from which he or she uses the website.
2.4 In addition to this Agreement, the Customer is bound by the general terms and conditions set out in the Privacy Policy.
Data security
3.1 Forlossningspool.se protects the Customer’s personal integrity and has high security requirements to prevent intrusion by unauthorized persons. When using the website to order products, the Customer may be asked to provide certain information about himself/herself, such as. name, username, e-mail address, telephone number, postal address, etc.
Such information about the Customer is private and confidential. Forlossningspool.se will not disclose such information to unauthorized persons. However, Forlossningspool.se may disclose information to authorities if there is suspicion of a crime or if otherwise required by law.
3.2 Forlossningspool.se processes the personal data provided by the Customer in accordance with the General Data Protection Regulation. Forlossningspool.se will process personal data for the following purposes:
- a) for the supply of products and the administration of orders,
- b) for quality work, analysis and development of products,
- c) for marketing directed to the Customer or for offers to the Customer related to forlossningspool.se’s products, or products and services provided or marketed by forlossningspool.se’s partners,
- d) to publish statistics on the products
- (e) for the performance of obligations imposed by law or governmental decision
3.3 Forlossningspool.se is the legal entity responsible for the Customer’s personal data. The Customer has the right, upon written request to forlossningspool.se, to receive information about which personal data about the Customer forlossningspool.se stores and processes.
The customer also has the right to request that inaccurate data be corrected, blocked or deleted. Furthermore, the Customer may, at any time, give written notice that the Customer does not wish to receive direct mail in the form of advertisements.
Use of cookies
4.1 Forlossningspool.se uses “cookies” to optimize the functioning of the website and to adapt it to the wishes of the Customer. A cookie is a text file that is either temporarily placed on the Customer’s computer memory (a “temporary cookie”) or is placed on the Customer’s hard drive (a “persistent cookie”) by a browser server. Cookies are not used to run programs or to spread viruses to your computer.
4.2 The purpose of a cookie is to tell a web server that you have returned to a particular page. When the Customer returns to the website, cookies enable forlossningspool.se to retrieve information previously provided by the Customer, so that the Customer can easily use the functions that he/she has customized.
Order & Order Confirmation
5.1 All sales, purchases and rentals under this Agreement shall be referred to as an “Order”. An Order is accepted only in accordance with these terms and conditions of purchase.
5.2 The Customer makes an Order on the Website by placing the Product(s) in the “Shopping Cart” and then selecting the method of payment. The customer must also fill in personal and delivery details and choose the shipping method. To confirm the purchase, the customer must accept the terms and conditions and click on the “Complete purchase” button.
5.3 Once the Order is completed, the Customer will receive an “Order Confirmation” by e-mail. Please double-check in the spam folder if the order confirmation has not been received. The Order Confirmation contains all information about the Product(s), price(s) of the Product(s) including VAT (in case of delivery within the EU) and other charges, delivery date, delivery costs, payment terms, information about the Customer’s right of withdrawal (as stated in section 14 below), applicable warranties and other services provided by forlossningspool.se as well as terms and conditions for cancellation of the Order.
For shipments outside the EU, the order confirmation does not include local charges or customs duties. These costs are to be paid by the customer to the local authorities.
Delivery
6.1 The Products will normally be delivered within fourteen (14) working days, unless otherwise agreed or specified in the Order Confirmation, and will be delivered to the Customer by traceable shipment (“Delivery”). Forlossningspool.se reserves the right for possible adjustment of delivery time.
6.2 For delivery outside Sweden, we ask the Customer to contact forlossningspool.se.
6.3 The risk in the Product shall pass to the Customer when delivery has taken place in accordance with section 8.1 above.
Delay
7.1 Delay on the part of forlossningspool.se exists if the Product/Products are not delivered on time and the delay is not due to the Customer or to other causes for which the Customer is not responsible, or in case of force majeure.
7.2 In the event of delay, the Customer has the right to withhold payment and demand performance of the Order or, if the delay is of substantial importance, to cancel the Order.
Responsibility for errors
8.1 A Product is defective if the Product deviates from what is stated in the Order or in any other respect deviates from the Customer’s legitimate expectations on the basis of the information provided by forlossningspool.se.
8.2 The product shall also be deemed defective if forlossningspool.se has failed to inform the Customer prior to the sale of a matter relating to the characteristics or use of the product that forlossningspool.se knew or should have known about, and about which the Customer could reasonably expect to be informed, provided that such failure can be assumed to have affected the purchase.
8.3 If a product is defective, the Customer has the right to request repair, redelivery, price reduction or compensation to rectify the defect, withhold payment or, if the defect is of material importance to the Customer, cancel the purchase.
8.4 Forlossningspool.se has in the first instance the right to offer repair or redelivery if this can be done within a reasonable time and without any additional costs for the Customer.
8.5 Forlossningspool.se is only responsible for original defects, which means that the defect existed before the time when the Product was purchased or delivered. Within a period of six (6) months, the defective product will be deemed to have an original defect that must be remedied by forlossningspool.se at no cost to the customer, unless forlossningspool.se can prove that the defect did not exist at the time of purchase. After this six-month period, the Customer must prove that the product was already defective at the time of delivery.
Right of withdrawal, complaints & defects
9.1 The Customer has the option to exercise the right of withdrawal without further explanation and return the product(s) within fourteen (14) days of receipt. If the Customer wishes to exercise the right of withdrawal, this must be notified to forlossningspool.se within the time limit. For an approved return, the buyer must handle both the product and the packaging with care. If the packaging is broken, it should be done carefully. The product(s) must be returned in original condition and with all accessories.
9.2 The Customer must complain about the defective Product to forlossningspool.se within a reasonable time after the defect has been discovered (“Complaint”).
9.2 The Customer must notify forlossningspool.se, orally or in writing, why he or she considers the Product to be defective. If the Complaint is made within two (2) months after the discovery of the defect, the Complaint shall be deemed to have been made in time. After three (3) years, the Customer loses its right to claim defects in the Product, provided that no warranty with a longer term has been given.
9.3 The Customer complains by ordering a return form from forlossningspool.se, completes the return form and returns it together with the faulty Product to forlossningspool.se by traceable mail.
9.4 Forlossningspool.se will reimburse the Customer for costs associated with the complaint provided that the product(s) is (are) faulty or the Customer has received a product other than the one ordered.
9.5 If repair or replacement is not carried out within a reasonable time after the Complaint has been made, the Customer has the right to demand a price reduction or to cancel the purchase of the Product in question.
9.6 Cancellation of the purchase is made by sending an e-mail to kontakt@forlossningspool.se.
In the event of cancellation of the purchase of the Product in question, the Customer shall return the Product in accordance with the Complaint procedure set out in section 9.3 above.
In the event of a complaint, the Consumer Sales Act (1990:932) is applied and in the event of a dispute, forlossningspool.se follows the recommendations of the General Complaints Board(ARN).
9.7 Otherwise, there is a 30-day cooling-off period from the time the Customer collects the order. When changing the product or size, the customer should send the product as a return, and then place a new order via the website. The customer is responsible for the return cost.
Prices
10.1 The price(s) of the product(s) are stated in the order confirmation.
10.2 All prices in the Order Confirmation are quoted in Swedish kronor and include applicable VAT (currently 25%) and any other taxes for delivery within the EU. Customers ordering products from outside Sweden may also be liable to pay customs duties. Customs duties are not included in the prices and any additional customs duties shall be paid by the Customer to the customs or equivalent authority of the country to which the Product(s) are finally delivered.
10.3 The prices quoted on the Website and in each Order Confirmation are subject to increases in supplier costs, printing errors, other mis-stated specifications and to clearance sales.
10.4 Offers, promotions or influencer codes cannot be used on previous purchases or in combination with other offers, promotions or discount codes.
Payment
11.1 Payment can be made by credit card or debit card, or by invoice payment or instalment payment in cooperation with Nets. In case of payment by credit card, the amount will be charged directly.
11.3 The product/products belong to forlossningspool.se until full payment has been made.

Force majeure
13.1 Forlossningspool.se shall be released from liability for failure to perform any of its obligations due to a circumstance that prevents, delays or aggravates the performance of an obligation under this Agreement, such as acts or omissions of public authorities, new or changed legislation, labour disputes, blockades, fire, flood, shortage of means of transport, goods or energy or serious accidents as well as failure or delay in deliveries from subcontractors caused by such circumstances (“Force Majeure”).
13.2 When forlossningspool.se wishes to invoke an event of Force Majeure, forlossningspool.se shall notify the Customer thereof without unreasonable delay.
Changes & additions to the purchase conditions
14.1 Forlossningspool.se reserves the right to make changes to the Terms of Purchase at any time. If/when changes are made to the Terms of Purchase, these will be made available on www.forlossningspool.se/kopvillkor.
14.2 Forlossningspool.se reserves the right, at any time, to take changes and measures, immediately and without prior notice, due to legislation or regulations from authorities.
Applicable law & dispute management
15.1 Swedish law shall apply to the contract.
15.2 Disputes arising from the Agreement shall be settled by the Swedish courts.
